Background In 2010 West Suffolk Hospital NHS Trust was challenged by the BMA on behalf of a number of junior doctors regarding the working practice of their rota. These representations were based on evidence provided through monitoring exercises, undertaken during the doctors' placement at the hospital. The BMA claimed that the exercises in question showed the rota to be non-compliant with both the New Deal and European Working Time Directive due to the following: - a failure by the Trust to ensure that the doctors received their natural breaks on at least 75% of their duties; - the Trust target for natural breaks should have been 100% rather than 75%. The doctors claimed that the working pattern on the rota was non-compliant for the relevant period and that this had been accepted by the Trust, and therefore that band 3 payments should be made. If successful, this would have resulted in the Trust making over £750,000 of additional salary payments for past, present and future doctors of this rota.

Salisbury NHS Foundation Trust is a major acute trust serving over 200,000 people in Wiltshire, Dorset and Hampshire. Every year we take care of over 40,000 A&E cases, 20,000 day surgery cases and 30,000 inpatient admissions. Our specialist services, such as burns, plastic surgery, cleft lip and palate, genetics and rehabilitation, extend to a much wider population of more than three million people. The Duke of Cornwall Spinal Treatment Centre at Salisbury District Hospital covers most of southern England with a population of approximately 11 million people. Trust staff provide outpatient clinics in other locations in Dorset and Hampshire. Specialist staff hold outreach clinics in hospitals within the Wessex area and, in total; the Trust employed 4,116 staff at 31 March 2010. This includes full and part-time staff. Currently the Trust has over 300 users of BigHand's digital dictation software, with over 180 Authors and 80 Secretaries, covering 22 clinical departments including Urology, Plastics and Oral Surgery and Paediatrics. During the month of May 2011, this equated to the completion of over 12,000 dictations.

With the proliferation of electronic patient information, hospital administrators, compliance officers,privacy officers and information security officers are required to enforce patient privacy. Motivated by patient-citizen damages from increased healthcare privacy breaches, law-makers across the United States, Canada, and Europe have enacted new regulation protecting patient privacy and penalizing those involved. Snooping, identity theft and general inappropriate access of medical records are now explicitly prohibited. Additionally, a patient's right to know who has accessed their records has been expanded,requiring hospitals and their business associates to account and disclose for personal health information breaches. Beyond putting patients at risk, personal health information breaches are increasingly putting healthcare organizations at a significant risk of financial, and reputational harm.
